Act amending and supplementing the Act on Working Hours and Mandatory Rest Periods of Mobile Workers and on Recording Equipment in Road Transport (ZDCOPMD-I)

It was published in the Official Gazette of the Republic of Slovenia, No. 32 of 6.5.2025 Act amending and supplementing the Act on Working Hours and Mandatory Rest Periods of Mobile Workers and on Recording Equipment in Road Transport. The amendment to the ZDCOPMD-I regulates the working hours of mobile workers – professional drivers, the keeping of records on the use of working hours, and the storage of tachograph data.

A provision has been added to the provisions on average weekly working hours, stating that a collective agreement at the sectoral level may determine that, in cases where this is dictated by objective or technical reasons or reasons for the organisation of work, the weekly average of 48 hours may be exceeded for a period longer than 4 consecutive months, but not longer than 6 consecutive months.

According to the amendment, employers must keep records of the use of working time in accordance with the legislation governing records in the field of labor and social security, and the records must include driving time, time of other work, time of availability, time of breaks and rest, a mark as to whether the work was performed when driving with multiple drivers, and weekly working time, which must show whether the weekly average was exceeded. For drivers performing international transport, only the electronic method of keeping records is used, but for them it is also necessary to enter some other data in the records: the place and time of the beginning and end of the working day, border crossing, and loading/unloading.

The new provision concerns the obligation of the employer to inform workers about regulations (this Act, ZDR-1, collective agreement, general acts of the employer and other regulations) in the manner specified in ZDR-1, and regarding the retention of data for the purposes of supervision under the law, namely that certain data is stored at the employer's headquarters by date of travel and individual vehicle, and certain data by date of activity for each mobile worker. The employer must store the data for 5 years after the end of the period to which it relates, after which it is deleted and the documentation is destroyed.

The powers and authorities in the field of supervision are more clearly defined, and the inspectorate responsible for public passenger transport is newly designated as the supervisory authority for supervising the implementation of the law. The amendment also supplements the provisions on misdemeanors for drivers and transport operators who do not respect the rules on driving times, breaks and rest periods, and the use of tachographs.

The amendment enters into force on the fifteenth day after its publication in the Official Gazette of the Republic of Slovenia, i.e. 21 May 2025.
